A solicitor for the Plaintiffs counsel, Chindak James Dakas Esq, have accused the management committee chairman of Jos North Local Government Council, Shehu Bala Usman for illegal inheritance and inability to vacate the property known as R.of O. PL2814 which is located at Chalim House Estate No.1, University of Jos senior staff Quarters Road close, Bauchi Road Jos, Plateau State, belonging to late Chief Dr. Anthony Jahota Jiwul, despite court order.

Barrister Dakas also faulted Mrs.Ladi A. Madamki, acting registrar Plateau State High Court for conniving with Defendants counsel, Panmak Mark Lere Esq who have continued to encourage the 2nd to the 10th contemnors which continue to show gross  disrespect to the Honourable Court.

Recall the 9 Plaintiffs approached High Court division Jos, with their motion on notice dated 12th December, 2019 brought in pursuant to section 6(6) (a) of the constitution of the Federal Republic of Nigeria (cap.c23) LFN  2004 and under the inherent jurisdiction of the honorable court.

The Plaintiff’s family are Mr. Godwill Jiwul, Engr. Solomon Jahota Jiwul, Walter Jahota Jiwul,Esq, Mrs. Margaret B. Jiwul, Mrs Clara Gambo, Mrs. Sarah Pennap, Barr. Grace Akpan (Mrs) and Miss Regina Jahota Jiwul have filed a suit No PLD/J608/2019 challenging the following; A.J.Jiwul limited, Parisa Jahota Jiwul, Bala Gotom, Ade Musa Ajoto, James Jahota Jiwul, Emmanuel Jahota Jiwul, Jonathan Jahota Jiwul, Sebastian Kopshang, Ignatius Gambar, Dimka Williams, Rayfield Medical Services ltd and Nigerian Air force military hospital Jos as defendants respectively.

The plaintiffs pray the order of injunction of the Hon. Justice I.I. Kinda which was granted them on the 8th November, 2019 in relation to the suit and the consent judgement of the Hon.Justice D.G.Mann entered on the 7th March, 2018 in a suit No PLD /J287/2015 consent judgment.

The plaintiffs’ counsel James Dakas Esq, added that for such further orders at this honourable court may deem fit to make in the circumstance.

Plaintiffs counsel further explained that the contemnors have remained contemptuous of the judgment which ordered the 3rd and 4th contemnors to stay away from the late Chief Jiwul family and also restored the inter vivos gifts mention in paragraph 6 of the consent judgement and described as the houses given to the plaintiff’s former wives and children should be returned to them which most of the inter vivos gifts are located in the property known as R of O .PL2814 and located at chalim house Estate ,road No 1 university of Jos senior staff quarters Road close ,Bauchi Road Jos. Plateau state (Chalim House Estate)and currently a further subject of litigation in this suit filed on 12th November, 2019 ,in suit PLD /J578/2019 filed on 5th November, 2019 and in suit No .FHC/J/CS/33/2019/filed on 13th September, 2019 all of which panmak Mark Lere Esq has been appearing as counsel for the 2nd to the 10th contemnors.

He also reiterated that the court has a sacred duty to protect its integrity, Majesty and honour whilst at the same time protecting the administration of justice from the Capricious tendencies of the contemnors sought to be committed registry.

"The actions of the contemnors sought to be committed are regrettable and condemnable as it portent a grave danger on the dignity, integrity and honour of the court in this country.

"The actions and conduct of the contemnors is a brazen disregard and disrespect to the dignity, integrity sanctity, Majesty and honour of court order of injunctions and consent judgment with disdain, disrespect, and impunity", Plaintiffs counsel mentioned.

However, the absence of Justice Arum Ashom on Tuesday stalled hearing as the case was adjourned to 5th February 2021 for moving on the motion on notice by the plaintiffs’ counsel.
