  A Senior Magistrate  Court sitting in Kasuwan Nama, Jos North Local Government Area of Plateau State has imposed a whopping sum of N5,000,000.00 and two surety with passport photographs including landed properties as bail conditions to Chief Amb. Yohanna Margif.

This was formed part of the Court anonymous decision when bail application tender before it by Barr. M.B Abdullahi counsel to chief Margif after he pleaded no guilty.

You would recall the Defendant (Chief Amb Yohanna Margif) was arraigned before the court on Tuesday by the Commissioner of Police Plateau State command on alleged N28, 000,000.00 fraud.

It was gathered that in one count charge of criminal  breach of trust between Sule A.Bashir, Eliya Gajere and Amb. Yohanna Y. Margif at Plateau State Command the suspect (Margif ) in 2011 bought cars amounted to 28 million promised to pay in two weeks paid bound cheque of Union.

According to the prosecution counsel, Barr.M.N.Alex since after issuance of Union bound cheque the suspect absconded and relocated to Abuja which is a criminal breach of trust punishable under section 297 ,307,294 of plateau state panel code law.

The prosecution  counsel also opposed the bail application, urging the court to denied the suspect bail because he has jumped administrative bail thrice granted him by the Plateau State Police command, make an order for an accelerated hearing of the matter.

Abdullah argued that they are not opposing the application as he also apply for bail under section 36 (5) 36(6) of the 1999 constitution of resumption innocent ,the accused person will not jump bail and can't temper with investigation and would provide a credible surety in this regard.

He said under section 117 & 182 the position of the law is very clear saying, the court can't refuse his bail because the defendant is not physically feet.

In his ruling on the application and counter-application for bail ,the  Judge upheld  arguments that the defendant should be granted bail.

The presiding judge adjoined the matter to 24th February, 2023 for the continuation of hearing.
