Sequel to the alleged removal of the right kidney of Mrs Kehinde Kamaru Bausari during her appendix operation at Murna Clinic and Maternity located in Yanshanu Community of Jos North Local Government Area of Plateau State, victim family filed a suit demanding justice and compensation.
The court ordered that the counsel to the 1st defendant Barr. E.A Achoba to present the dead certificate of , Dr Noah Kekere before taking decisive measure whether to continue or discontinue with his name in the lists of the defendants.
However, when the matter came up for case management, between Kehinde Kamaru and the suspected organ harvesters, Dr Noah Keller and Yusuf Abdullahi including, Murna Clinic Maternity Ltd and Attorney General and Commissioner of Justice, Plateau State.
Chief Bankole Falade, the Senior Advocate of Nigeria (SAN) told journalists that they were in court for compensation for his client who had suffered multiple wounds and injuries as aresults of kidney operation.
According to him, they have a pending motion before counsel to the 1st and 4th defendants raised issue that he is not ready to proceed with the matter because of his client's dead.
The second issue is that they were not officially serve by the claimant counsel which include the 5th and 6th defendants who also brought fresh application seeking for extension of time.
Achoba urged the court to strike out the name of his client, Dr Noah Kekere who is now dead, stressing that there is need to allow his name as defendant objecting to the application of the claimant counsel.
However, Bankole Falade,SAN, urged the court to adjourn to 31st March, 2026, to enable the defense counsel present a dead certificate of Dr Noah Kekere.
He added that now, we cannot file another motion if the dead certificate of the 1st defendant not produce.
The court has adjourned to the 31st March, 2026 for case management and to allow the claimant counsel to further file his amended motion of claims.
Speaking to journalists after session, Chief Bankole, explains that they approach the court for compensation and claim damage inflicted on his client.
He said, we are not part of the first suit but what happened in court today was on our case management and the matter couldn't go on due to lack of service by bailiff.
