A High Court sitting in Jos, Plateau State Division has adjourned to the 22nd November, 2022, for ruling on the application filed by the APC governorship candidate in Plateau, Dr. Nentawe Yilwatda seeking to join the matter filed before the court by some aggrieved APC prospective delegates in the state.

Recall the APC aggrieved delegates has since instituted a legal action challenging the party leadership under Hon. Rufus Bature for their exclusion as the legitimate delegates of the party during primary elections, instead decided to used other persons who are not known which is against the law.

 The Claimants, said were the persons who purchased APC delegates form to perform wards Congresses and were disfranchised.


The matter which is before Justice A.I Ashon come for hearing counsel representing  Nentawe A.G Yirvoms Esq, told the court that they are  having motion on notice dated 24th Oct,22 ,supported by 18 paragraph affidavit and relies on all the depositions there in.

He further pointed out that attached to the application is exhibit A,B &C, accompanied by written address.

He, however prayed the court to grant the application, stressing that the crux of their application is that his client (Dr.Nentawe Yilwatda) who is the governorship Candidate of the party APC,is a product of primary election  that was conducted. "I am urging my Lord  to grant the application to join on the matter because it  affect my client (Nentawe) directly."

In his argument, counsel to the Claimants (APC delegates) S.A Abba Esq, vehemently disagreed with the position of Nentawe for  claiming to be a product of the election.

 Abba in his deposition filed counter affidavit, dated 30th October,22, with 4 paragraph Counter affidavit accompanied with written address.

He said the suit of the Claimants is challenging their exclusion from APC, so Nentawe is not an officer of the party,the position is the cause of action before the Applicant become flag bearer.

Shedding more light after the proceedings the Claimants counsel opines that, "their Lawyer argue their application we also argue ours and the court has been adjourned to 22nd November, 2022 for ruling on whether would Nentawe be join or he should not be join on the matter, and until then for now our fingers are crossed. And we hope that he should not be join!

"Our own opinion is that, he has no business in this case because what he has expressed are the functions and duties been carried out by the All Progressive Congress, APC, and he is not an officer or official of APC, he is only a candidate who is running on their platform.

"We have filled an originating sermon on the 24th May, 2022. Nentawe through his Lawyers are seeking to joint the suit and the application is predicated on an amended originated sermon dated on the 4th September, 2022, and that originated sermon has not come into live. 

"It is a dorsal document. It is improper, and that is why we are saying is what they are seeking to join is improper. Is like entering into a house that doesn't exist. I am sure that is why they wanted to join this case. They don't even understand the natty gritty of what is going on!

Counsel to Nentawe, A.G. Yirvoms contained that the Claimants counsel "having withdrawn that application and relaying on his first application which the prayers are lifeless it means all issues have been taking by event because the primary elections were already conducted. The issues were overtaken by events."

Meanwhile, Justice A.I Ashon has adjourned the matter to the 22nd November,2022 for ruling on the application on whether Nentawe should join on the suit or not  before the substantive matter.
